Fan & Creator Agreement – OnlyAlphas

1. Introduction

This Standard Contract between Fan and Creator ("this Agreement") sets out the terms governing each transaction between a Fan/Subscriber and a Creator on https://onlyalphas.vip/.


2. Applicability

Each time a Fan/Creator Transaction is initiated on OnlyAlphas, this Agreement applies exclusively and legally binds both the Fan and the Creator. Any other terms proposed by either party are excluded.


3. Interpretation

Defined terms:

  • OnlyAlphas: the website accessed via https://onlyalphas.vip/

  • Content: any material uploaded by a Creator or Fan (photos, videos, audio, livestreams, text, metadata, interactive features, emojis, GIFs, memes, etc.)

  • Creator: a User who posts Content on OnlyAlphas for Fans to access

  • Fan: a User who subscribes to or interacts with a Creator’s Content

  • Fan/Creator Transaction: any subscription, pay-per-view (PPV), or fan interaction payment

  • Fan Payment: any payment made by a Fan (including tips)

  • TFF: OnlyAlphas platform fee applied to Creators

  • Subscription: recurring monthly access to a Creator’s account

  • Tax: any applicable taxes, duties, or levies in any jurisdiction


4. Pricing and Payment

  • Fans pay the amounts listed on the Creator’s account plus applicable VAT or taxes.

  • OnlyAlphas acts as payment intermediary: collecting payments, deducting TFF, and distributing earnings.

  • Creators are solely responsible for declaring and paying any taxes due on their earnings.


5. License of Content

Once a Fan completes payment, the Creator grants the Fan a limited, non-transferable, non-sublicensable license to access the Content for personal use only. Caching or temporary technical copies are permitted solely for viewing.


6. Ownership of Content

Creators retain all ownership rights to their Content. Fans acquire no ownership rights.


7. Expiry of License

The Fan’s license ends automatically if:
a. Payment fails, is reversed, or charged back
b. Subscription period ends (unless auto-renewal is active)
c. Fan account is suspended or terminated
d. Fan violates OnlyAlphas TOS or Community Guidelines
e. Creator removes Content
f. Fan closes their account


8. Cancellation and Refunds

  • Fans acknowledge that Content is delivered immediately upon payment ( unless stated for example custom request) ; statutory cancellation rights may be waived where legally permitted.

  • Refunds may be issued only where required by law or proven fraud.


9. Creator Responsibilities & Liability

Creators assume full responsibility for all Content uploaded and all Fan/Creator Transactions. Specifically:

  • Creators must comply with all OnlyAlphas TOS, rules, and applicable laws.

  • Creators warrant they hold all necessary rights and permissions for the Content they upload.

  • Creators are solely liable for any legal violations, copyright infringements, non-consensual content, or breach of TOS.

  • OnlyAlphas is not liable for any loss, damages, claims, or disputes arising from Creator Content or actions.

  • Fans access Creator Content at their own risk, except in cases of OnlyAlphas negligence.


10. Fan Obligations

  • Fans agree to make all required payments and not initiate unjustified chargebacks.

  • Fans must comply with OnlyAlphas TOS and Community Guidelines.


11. No Guarantees

  • Creators may add or remove Content at their discretion.

  • Access to Content may be interrupted if:
    a. Creator account is suspended or deleted
    b. Fan account is suspended or deleted
    c. OnlyAlphas site is temporarily unavailable
    d. Creator is unable to provide Content in the future


12. Dispute Resolution & Governing Law

  • This Agreement is governed by U.S. law, but Fans retain mandatory rights under local law.

  • Venue for disputes:

    1. Fans in the U.S.: courts of Fulton County, Atlanta, Georgia

    2. Fans outside the U.S.: courts of Fulton County, Georgia, unless otherwise agreed
